Personal information

Certain areas of SmartPhish.com are available to you without registration or the need to provide to us any information.  However, in order to benefit from the full functionality of the Service, you need to register as a member, which will include a valid e-mail address and password.  You may need to provide other information such as your zip code if you want to show up in search results or use other really cool features.

If you would like to enable SMS reminders or alerts, you will have to provide your mobile phone number.

It is possible that other information will be needed to utilize all site features. 

Most of your personal information can be changed but some can't.  We do this to maintain the integrity of the feedback system on our site.  We don't want people with poor feedback to sign up with a clean slate under a different name.  If you make a mistake like misspelling your own name, contact us at help@smartphish.com . 

Your private information and financial data is strictly limited to SmartPhish employees and/or contractors, only on an as needed basis, in order to operate, develop new features or improve the site.  Any employee or contractor who violates your trust will be dealt with accordingly and will most likely face termination and public ridicule. 

You understand that information you provide on your profile is public information and will be available for the public to view.  Exceptions to this are your email, address, and financial information.  We will try to make it obvious which data will be shared with the public. 

Private Information

SmartPhish does not sell or rent your private information at any time. 

Private Information will include email address, financial information and address.

SmartPhish uses your private information only as follows:

• to make or charge payments

Online session information is used to improve your experience

When you visit SmartPhish.com, we may collect technical and navigational information, such as computer browser type, Internet protocol address, pages visited, and average time spent on our site.  The information will be used to enhance your experience on our site and tell us where we are doing a good job and where we aren't. 

We will use Google Analytics to see how you are using our site.

Blogs and Forums on SmartPhish.com

If you use a forum, blog, or chat room on this Web site, you should be aware that any information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages.  We won't be doing this, but we can't, as with any other website, guarantee that nobody else will.  We are not responsible for the personally identifiable information you choose to submit in these forums.  It is up to you what you share here.

Contests, Giveaways and Surveys

From time to time, SmartPhish may offer you the opportunity to participate in contests, giveaways and other promotions.  Any information submitted in connection with such activities will be treated in accordance with this privacy policy.  From time to time, SmartPhish may also ask you to participate in surveys designed to help SmartPhish improve the Web site.  Any Personally-Identifying Information provided to SmartPhish in connection with any survey will be used only in relation to that survey.  Personally identifiable information will not be shared. 

SmartPhish may aggregate survey data and disclose such data only in aggregate and in a non-personally identifiable manner to:

Disclosure of your information to protect our rights or if required by law

Notwithstanding the foregoing, SmartPhish reserves the right (and you authorize SmartPhish) to share or disclose ALL of your information, both public and private, when SmartPhish determines, in its sole discretion, that the disclosure of such information is necessary to identify, contact, or bring legal action against you if:

• You are or may be violating this Privacy or SmartPhish's Terms of Use;
• to prevent potentially prohibited or illegal activities; or

Your data may be transferred upon acquisition of SmartPhish

All information may be transferred to a third party as a result of a sale, acquisition, merger, reorganization or other transfer (a "Transfer") involving SmartPhish.  SmartPhish specifically reserves the right to transfer all information to a third party in connection with a Transfer.  Should such a Transfer occur, we will use our best efforts to require that the new combined entity follow this privacy policy with respect to your personal information, as and to the extent required by applicable law and require that you receive prior notice if your personal information could be used contrary to this policy.

You can delete your data

We will delete your account at your request.  Note that this deletion is permanent and may not be restored.  It is possible that your data could remain on our servers somewhere somehow.  Note that if you make video lessons, you will NOT be able to delete these along with your profile.  It is up to SmartPhish if and when your videos will ever be deleted. 

Cookies & Web Beacons are used to analyze usage & improve the Service

"Cookies" are alphanumeric identifiers in the form of text files that are inserted and stored by your Web browser on your computer's hard drive.  SmartPhish may set and access cookies on your computer to track and store preferential information about you.  SmartPhish may gather anonymous information about you through cookie technology.  For example, SmartPhish may assign a cookie to you, to limit the amount of times you see a particular SmartPhish Offer or to help better determine which SmartPhish Offers to serve to you.  Please note that most Internet browsers will allow you to stop cookies from being stored on your computer and to delete cookies stored on your computer.  If you choose to eliminate cookies, the full functionality of the service may be impaired for you.

We encode our cookies so that only we can interpret the information stored in them.

Web beacons are images embedded in a Web page or email for the purpose of measuring and analyzing site usage and activity.  SmartPhish, or third party service providers acting on our behalf, may use Web beacons to help us analyze site usage and improve the Service.

We comply with CAN-SPAM regulations for our newsletters

SmartPhish.com sends only verified, double-opt-in e-mail newsletters, specifically requested by SmartPhish subscribers.  Subscriptions to SmartPhish.com newsletters are verified by sending an e-mail confirmation to your e-mail address, which requires a positive response before an e-mail address is added to the SmartPhish newsletter list.  SmartPhish.com is fully compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003.

Because we provide you the option of receiving our promotional newsletters, SmartPhish.com subscribers have the ability to opt-out of receiving these newsletters.  We also will send users service-related emails which they do not have the ability to opt-out of. 

We use authentication to ensure that only you access your account

Authentication is the process you go through on SmartPhish to access secure areas of our Website.  This process takes place when you log into your account, the two key components of which are your Login ID and Password. 

We recommend that you change your password periodically.  You are responsible for maintaining the security of your Login ID and Password.  You may not provide these credentials to any third party.  If you believe that they have been stolen or been made known to others, you must contact us immediately at privacy@SmartPhish.com to request a change.  We are not responsible if someone else accesses your account through information they have obtained from you or through a violation by you of this Privacy Policy or the SmartPhish Terms of Use agreement.
